These general conditions of use (hereinafter “GCU”) constitute the contract setting out the conditions of use of the www.e-Nable.fr website published by E-NABLE.

“service user”: user of the matchmaking service.

Introducing e-nable
The purpose of the e-nable association is to run a network of volunteers who, using 3d printing techniques or any other technique that achieves the objective, create assistive devices for upper or lower limbs, to be offered to people over 5 years of age with agenesis or who have been amputated.
E-nable puts a recipient in contact with a maker so that the latter can manufacture and offer the recipient a custom-made device using 3d printing techniques or any other technique that enables the objective to be achieved. This relationship is governed by the general terms of service available here.
The information contained on the site is information about the association’s project and this matchmaking service.
E-nable makes no claim to the completeness or exhaustiveness of the information contained on the site. The user is informed and accepts that some information may not be included and that certain situations may not be described.

Access to the site and to the contact service
Iii.1 – Site access
Access to and use of the site are subject to the present general conditions of use and to all legal and regulatory provisions in force.
Any connection to the site is subject to compliance with these general conditions of use. For the user, access to the site implies acceptance of all the general conditions of use.
In order to use the site, the user must have Internet access, the cost of which is borne by the user.
E-nable makes every effort to provide access to the site 24 hours a day, 7 days a week, except in the event of force majeure or an event beyond e-nable’s control, and subject to any breakdowns and maintenance operations necessary for the proper functioning of the site. Consequently, e-nable cannot guarantee site availability, transmission reliability or performance in terms of response time or quality. No technical assistance is provided to the user, either electronically or by telephone.
e-nable cannot be held liable for any inability to access the site and/or use the service.
Furthermore, e-nable may interrupt the site at any time without notice and without entitlement to compensation.
Iii.2 – access to the matchmaking service
The matchmaking service is only accessible to single recipient members or minor children of single recipient members, and to validated makers of the e-nable association (service users). It therefore requires prior membership of the e-nable association as a simple recipient member or simple maker member.

To apply for membership, please fill in the membership application form (available here) and create an account.
When opening an account, service users undertake to :
Not to provide false information about their identity, nor to impersonate any third party,
Keep their account for their own use only,
Not to use his account for commercial, advertising or promotional purposes, or to attempt to attract customers or patients,
Not to divulge his or her password or allow anyone else to access his or her account, or do anything that might compromise the security of his or her account. Passwords are personal and confidential. The service user is solely responsible for it. Service users are solely responsible for the use of their account. Any transmission or publication of information using your password will be deemed to have been made by you and under your sole responsibility. In the event of fraudulent use of his account and/or password, he undertakes to inform e-nable immediately.
An e-mail confirming the application will then be sent. Once the e-nable office has validated the membership application, the person concerned will receive an e-mail confirming membership of the e-nable association.
Once membership has been validated, any recipient who is a simple member of e-nable may apply for a device, on his or her own behalf or on behalf of his or her minor child, by means of an application form accessible on the www.E-nable.Fr website, after having read and accepted the general terms and conditions of service, accessible here: cgs.
A maker’s access to the service requires prior validation by e-nable, and a validation request must be submitted, after having read and accepted the general terms and conditions of service, available here.
Device or validation requests are made via a form accessible on the site from the account created when the membership request was made.
User obligations
All users undertake not to hinder or obstruct the use of the site by other users.
They may not use the site to carry out any illegal activity or to violate the rights of third parties.
They may not use the site for commercial, promotional or advertising purposes, or in an attempt to attract customers or patients.
He/she undertakes to disseminate content and information free of viruses, trojans, or any other logical tool/medium intended to damage, harm, intercept or hinder any e-nable system and/or the data or information disseminated.
He/she undertakes not to disclose any confidential information or information covered by professional secrecy to which he/she is bound or for which he/she is bound by a confidentiality clause.
Intellectual property – image rights
E-nable is the exclusive owner of the intellectual property rights relating to the structure and content of the site.
E-nable grants the user a right of access and use free of charge, non-exclusive, non-transferable, personal and limited to access and personal use of the site. This right is granted exclusively for personal and non-commercial use. Any other use is strictly forbidden.
Any use, reproduction or representation, in whole or in part, made without the consent of e-nable, as well as any translation, adaptation or arrangement of the site or elements of its content, by any means whatsoever and on any medium whatsoever, constitutes an infringement punishable by the French Intellectual Property Code.
The user is strictly forbidden to reproduce or represent the photographs on the site.
Similarly, any use or reproduction of the e-nable name, brand and logo is prohibited.
Responsibility
E-nable in no way guarantees the conformity and suitability of the site and the information published therein to the needs of users.
Any use of the information provided on the site is at the user’s own risk, and the user assumes all consequences arising therefrom, without any liability on the part of e-nable, and without recourse against the latter. E-nable cannot be held responsible for any damage of any kind resulting from the interpretation or use of the information and/or documents available on the site.

Privacy policy
E-nable is responsible for processing personal data collected when joining the association, when requesting equipment and when requesting validation.
The provision of this data is contractual in nature. This data processing is necessary for the management of memberships and the association contract, as well as for the management of device requests, validation requests and the contact service, and for the contract concerning image rights.
The person concerned is informed of the obligatory nature of the answers by an *; if the obligatory fields are not answered, the device or validation request cannot be processed, and the service cannot be carried out. The personal data collected is strictly necessary for processing and managing these requests and the service.
Photographs depicting the recipient’s disability are essential for processing the request, as they enable us to offer a suitable device on the correct scale. The person concerned expressly consents to the collection and processing of photographs for the sole purpose of manufacturing this device.
Personal data may only be communicated to authorized third parties, i.e. e-nable france, the addressees, the requested valid makers and any healthcare professionals collaborating on the file.
The recipient expressly accepts that photographs depicting his or her disability may be communicated to able-bodied makers and, where applicable, to healthcare professionals collaborating on the project.
The person concerned accepts that personal information concerning him or her may be shared with a member of e-nable for the purpose of establishing contact and manufacturing the device.
Data is kept for the duration of the membership and for a period of 3 years after the end of the membership.
In accordance with French data protection legislation, the data subject is hereby informed that he or she has the right to access, rectify, delete and limit the processing of his or her data, the right to portability and the right to determine the fate of his or her data after death, in respect of all data concerning him or her. This right may be exercised by writing to contact@e-nable.Fr or by post to: association e-nable france – 4 rue martel – 75010 paris with a copy of a signed identity document. You also have the right to lodge a complaint with a supervisory authority.
In the case of photographs, the person concerned has the right to withdraw consent in the same way.
E-nable makes every effort to protect personal data against any form of damage, loss, misappropriation, intrusion, disclosure, alteration or destruction. Physical and electronic safeguards for data collected on the e-nable.fr website are implemented in accordance with current French laws on personal data.
